This English version is provided for the convenience of non-Polish-speaking users. In case of any discrepancy, the Polish version is the binding legal text.
User: a natural person aged 16 or over using the "Animolo / Żubr Radar" mobile application.
2. Acceptance of the Terms
Use of Animolo requires acceptance of these Terms and the Privacy Policy. Acceptance is given by an active click on the consent screen during first login or upon a material version update.
3. Account creation and requirements
Required age: 16 years or older (per GDPR Art. 8 and Polish law).
Login via Google or Facebook (authentication data comes from the OAuth provider).
One account per person. Group accounts and bot accounts are prohibited.
The user is responsible for the security of the underlying login account (Google/Facebook).
4. Use of the service
Animolo is a social application for sharing nature observations. It allows you to:
create observations (sightings) of animals, plants, fungi, and other forms of nature;
comment on and react to other users' observations;
broadcast a "presence" in friends-only or anonymous public mode;
build a "Spotter" / "Nature Hero" / "Species Guardian" profile;
browse information about species, national parks, and educational paths.
The service is free in its basic version. A premium subscription may be introduced in the future — you will be notified in advance.
5. User content and licence
You retain all copyright in your sightings, comments, photos, and notes. By posting content in the application you grant the Provider a royalty-free, non-exclusive, worldwide licence to use it as necessary to provide the service:
storage, transmission, display to other users in the app;
creating thumbnails, compression, optimisation for various devices;
backups and data transfer within the cloud infrastructure (Google Cloud, EU);
publication of aggregated statistics (e.g. "X bison sightings this month") without disclosing your identity.
The licence terminates when you remove the content or your account — within a maximum of 30 days your content will be erased, including from backups.
Animolo does not sell your photos or content to third parties. A future "marketplace" module (HD photo sales) will be opt-in — it requires separate consent and will pass the majority of revenue to you.
6. Prohibited conduct
You must not publish content or engage in conduct that:
breaches the law (Polish, EU, or third-country law where applicable);
contains hate speech, discrimination, threats, or harassment;
depicts or promotes violence against animals, poaching, habitat destruction, or violation of nature-protection laws;
contains sexual, intimate, or content unsuitable for persons under 18;
infringes others' copyright, trademarks, personal data, or image rights;
fakes observations (e.g. invented species, AI-generated images posing as real sightings, scam, spam);
discloses precise locations of strictly protected species in circumvention of the coarsening mechanism (attempts to bypass coarsening are grounds for immediate account suspension);
is used for automated scraping, denial-of-service, or attacks on infrastructure;
uses the application for commercial purposes without the Provider's consent;
creates multiple accounts in order to manipulate rankings or the reporting system.
Breach of the above rules may result in a warning, account restriction, suspension, or permanent removal of the account — depending on the severity of the breach. Where criminal law is breached, the matter will be reported to the competent authorities.
7. Moderation and reports (DSA)
Pursuant to Regulation (EU) 2022/2065 (DSA Art. 14, 16, 17):
Every piece of content (sighting, comment, presence photo, presence comment) has an in-app "Report" button with 7 categories (hate speech, violence, sexual content, copyright infringement, misinformation, poaching, other).
When a reporting threshold is exceeded (3 independent users), the photo is automatically hidden pending review (status photoModeration: 'pending').
Moderation decisions are reasoned (notice to the user citing the basis under DSA Art. 17).
You may appeal a moderation decision — within 30 days — by writing to contact@animolo.app.
Out-of-court dispute resolution: under DSA Art. 21 you may turn to a certified out-of-court dispute settlement body (the list of bodies is available on the European Commission's website).

Blocking users: in Settings you may block any user — their content will not be shown to you, nor yours to them.
Stay-down (DSM Art. 17): where content infringing copyright has been removed, we take reasonable steps to prevent re-upload of the same content.
8. Payments and premium
The basic version of Animolo is free. If we introduce a premium plan in the future:
price, billing period, and the list of features will be clearly communicated;
payment will be processed via the App Store / Google Play (their rules apply);
the consumer right of withdrawal applies within 14 days of purchase under Polish/EU consumer law — unless the consumer expressly requested performance of the service before the withdrawal period expired (Art. 38 pt 13 of the Polish Consumer Rights Act);
no automatic conversion from free to paid without your acceptance.
9. Suspension and termination
An account may be suspended or removed:
upon your request (Settings → Delete account), without giving a reason;
by the Provider in case of a material breach of the Terms (with notice where possible);
upon permanent discontinuation of the service (with 30 days' notice and the option to export data).
10. Disclaimers
The service is provided "as is". The Provider takes care to ensure continuity and security; however:
does not guarantee 100% availability (planned maintenance windows may occur);
is not responsible for the accuracy of observations made by other users (user-generated content);
is not responsible for the actions of third-party providers (Google, Apple, Facebook, OpenStreetMap, Wikipedia, iNaturalist) on their own infrastructure;
is not liable for indirect damages, lost profits, or non-pecuniary damages arising from interruptions — to the extent permitted by law (mandatory consumer-protection rules remain in force).
The above disclaimers do not limit the Provider's liability where such liability is mandatory (e.g. for gross negligence, wilful misconduct, or personal injury).
11. Complaints and dispute resolution
Complaints may be sent to contact@animolo.app. Response time: 14 days. For consumers: failure to respond within 14 days is deemed acceptance of the complaint (Polish Consumer Rights Act Art. 7a).
These Terms are governed by Polish law. Disputes are settled by the court having jurisdiction over the Provider's seat (Poland), without prejudice to consumer-protection rules (a consumer may bring proceedings in the court of their EU place of residence).
13. Changes to the Terms
We may update these Terms. Each material change increments the version and triggers a fresh consent prompt on the next app launch. Without renewed acceptance, account use is suspended, but data remains available for export.
